Terms & Conditions

These Terms & Conditions apply to all services offered by MUSOMA, including but not limited to music performances, wellness events, movement sessions, and collaborative bookings.

By engaging our services, making a booking, or attending a MUSOMA session or event, you agree to the following terms.

1. Bookings & Confirmations

  • A service is considered confirmed only after a completed booking form and deposit or full payment is received.

  • MUSOMA reserves the right to decline or cancel a booking if payment is not received within the agreed timeframe.

  • Bookings are confirmed in writing via email, including details of your event, performers, timing, and any agreed inclusions.

2. Payment Terms

  • Weddings & Proposals:
    A 50% non-refundable deposit is required to secure your date. The remaining balance is due no later than 14 days before the event.

  • Events (i.e. private events, special occasions, corporate events, brand activations, & wellness events):
    A 50% deposit is required to confirm your booking. The remaining balance is due 7 business days before the event.

  • Short Notice Bookings (within 14 days):
    Full payment is required upfront to confirm your booking.

  • Corporate & Institutional Clients:
    Invoicing with 7-30 day terms is available for approved organisations. Payment terms must be agreed upon in writing prior to the event.

  • Suppliers & Agency Partners:

    For approved event planning agencies and suppliers, MUSOMA honours pre-agreed payment terms, invoicing formats, and timelines as per the partner agreement. These may differ from standard terms and are managed on a case-by-case basis.

  • Overtime:

    If your event runs 15 minutes or less over time, there’s no extra charge. If the event exceeds that, additional fees will apply and be invoiced accordingly, payable within 7 days from issue date.

  • Currency & GST:
    All prices are listed in Australian dollars and excluding GST, unless otherwise stated.

  • Payment Methods:
    We accept EFT/bank transfer, credit card (surcharge may apply), and PayPal.

3. Cancellation & Refund Policy

Client Cancellations

Weddings & Proposals:

  • More than 30 days prior: Deposit is retained (non-refundable).

  • 8-30 days prior: 75% of the total booking is retained.

  • 0-7 days prior: No refund. Full payment is required due to preparation and scheduling.

Events:

  • More than 30 days prior: Full refund, minus a $100 admin fee.

  • 8-30 days prior: 50% of the total booking is retained.

  • 0-7 days prior: No refund. Full payment is required.

Unforeseen Circumstances

  • If cancellation is required due to factors beyond your control (e.g. severe illness, family emergency, natural disaster), we’ll do our best to reschedule your event or issue a credit valid for 12 months.

  • If we are unable to deliver the service due to our own illness or emergencies, we will offer a full refund or option to reschedule at no additional cost.

4. Public Liability & Risk Management

  • MUSOMA is covered by Public Liability Insurance for up to $30 million AUD. A Certificate of Currency can be provided upon request.

  • While we take all reasonable care in the planning and execution of events, attendees participate at their own risk.

  • Clients are responsible for ensuring a safe and suitable environment is provided for the session (e.g. clear space, access to power, shelter if outdoors).

  • For wellness sessions, we recommend participants consult a GP or healthcare provider before joining, particularly if pregnant, injured, or managing a health condition.

5. Event Conduct & Safety

  • MUSOMA reserves the right to refuse or cancel services if the safety of our team or participants is at risk due to unsafe venues, aggressive behaviour, or breach of contract.

  • All instructions given during sessions must be followed to maintain a safe, respectful, and inclusive environment.

6. Travel, Equipment & Set-Up

  • Travel within 20km of Sydney CBD is included. Additional travel charges apply beyond this distance or for interstate/international events.

  • Amplification, instruments, props, or wellness tools (e.g. yoga mats, incense, PA systems) can be provided — outlined clearly in your booking quote.

  • Clients are responsible for confirming venue access and timing to ensure smooth set-up and pack-down.

7. Changes & Rescheduling

  • Minor changes to the event (timing, location, performer) must be confirmed in writing at least 72 hours prior and are subject to availability.

  • Rescheduling is possible once per booking, provided it is requested more than 14 days prior and is rescheduled within 3 months.


8. Use of Media & Promotion

  • MUSOMA may photograph, film, or otherwise record any rehearsals, performances, wellness sessions, workshops, or other activities for marketing, training, and promotional purposes across MUSOMA’s owned platforms (including websites, social media, and digital channels).

  • Footage and photographs may include MUSOMA performers, clients, collaborators, musicians, facilitators, partners, suppliers, and event attendees, unless a written opt-out request is received prior to the event.

  • MUSOMA may also use official event promotional material (including posters, flyers, social media tiles, or digital ads) that mention MUSOMA or any affiliated sub-brands on MUSOMA’s owned channels, unless otherwise agreed in writing.

  • Any footage, images, or content shared by clients, collaborators, or third parties must credit MUSOMA appropriately and may not be altered in a misleading, defamatory, or derogatory manner.

  • Social media sharing by MUSOMA will always aim to provide accurate context and will avoid implying endorsements or affiliations without prior agreement.

9. Partnerships & Collaborations

  • For brand activations, workplace wellness programs, not-for-profit fundraisers, or co-hosted events, MUSOMA may enter into partnership agreements outlining specific terms such as roles, responsibilities, deliverables, timelines, revenue splits, expenses, branding, and intellectual property (IP) ownership.

  • Unless otherwise agreed in writing, MUSOMA retains ownership of all original creative content (including audio, video, written works, arrangements, and soundscapes) created by MUSOMA or its subcontractors.

  • Where MUSOMA performers, facilitators, or collaborators cannot attend a scheduled live event, MUSOMA may still contribute creative works (e.g. rehearsal recordings, pre-recorded performances) and share these in association with the event, on owned channels, provided the context is accurately represented.

  • Partnership agreements will be managed through separate contracts tailored to the scope of each collaboration, in addition to these Terms & Conditions.


10. Liability Limitations

  • While we do our best to deliver exceptional service, we are not liable for indirect or consequential losses arising from service delays, technical issues, or attendee conduct beyond our control.

  • Our liability is limited to the total fee paid for the specific service booked.


11. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia. Disputes will be resolved under the jurisdiction of NSW courts.
